While things have moved slowly over the past 50 years, the past 5 years have seen rampant progress and the birth of an exciting, innovative, and potentially life-changing industry.

While the CBD (cannabidiol) industry is currently booming in the UK, it wasn’t long ago that such products were exclusively reserved for underground markets. The cannabis plant has been banned around the world for many, many years, and this has left potential CBD users confused about the legality of cannabis-derived products like CBD. This has led many to ask the obvious question: is CBD oil legal in the UK?

Now we are in 2021 and it is legal to sell CBD both over the counter and as a prescription drug in the UK (see Epidiolex for an example). Research has increased rapidly in recent years, and the number of diseases that CBD can potentially benefit from is growing month by month.

First, for those who may be less aware of CBD, let’s first outline exactly what it is.

What is CBD?

There are over 100 different cannabinoids in the cannabis plant. The two most dominant compounds are CBD and its close relative THC (tetrahydrocannabinol).

Many people confuse these two compounds, but it’s critical to understanding how CBD works. THC is psychoactive, which means it can affect the way your brain works, while CBD cannot. CBD won’t get you up.

Additionally, there are three main types of CBD that you should know about. These are as follows:

  • CBD Isolate – CBD Isolate is the purest form of CBD that we can currently manufacture. It does not contain any other cannabis compounds and is usually sold in crystallized or powdered form.
  • Broad-spectrum CBD – Broad-spectrum CBD contains a large number of cannabinoids, flavonoids, and terpenes that are naturally found in the cannabis plant but do not contain THC.
  • Full Spectrum CBD – Full Spectrum CBD contains all of the cannabis compounds that broadband CBD does, but also contains traces of THC. One must be aware that the legal limit for THC in the UK is 0.2%, which is nowhere near enough to have a psychoactive effect on the user.

Since Roger Adams, an American chemist, first successfully extracted CBD from cannabis by ethanol extraction, it has been a long and arduous road to more sensible regulation. Let’s look further at how we arrived at the current state.

How can CBD be used?

Because of the huge influx of interest into the industry in recent years, we’ve seen rampant innovation.

Cannabis Laws in the UK – A Timeline

  • 1928 – The Dangerous Drugs Act introduces laws that make possession of cannabis a criminal offense. The conviction for this particular crime was reduced in 1967.
  • 1971 – The Drug Abuse Act was introduced in 1971, which banned the cultivation of all cannabis plants.
  • 2001 – Drug abuse regulations allow cannabis cultivation with a home office license.
  • 2015 – The term for drug abuse is introduced. This was the beginning of the legalization of medical cannabis.
  • 2018 – Medical cannabis will be finally legalized in November 2018.
  • 2020 – The Food Standards Authority (FSA) updates the classification to consider CBD as a novel food.

What is the UK legal THC limit?

THC, the psychoactive cousin of CBD, is illegal in the UK and can lead to incarceration in extreme circumstances. THC has been considered a Class B drug since the aforementioned 1971 Drug Abuse Act.

As mentioned above, medical cannabis containing THC was legalized in November 2018. However, the acquisition process is arduous. Not only is the prescription unavailable from the NHS, but it is rarely covered by private health insurance. As a result, the patient will have to spend at least £ 200 each month on the cheapest subscription available.

CBD, on the other hand, is completely legal in the UK and offers many of the same health benefits but with fewer side effects. Even so, there have been rare cases where unscrupulous CBD companies have supplied illegal products containing more than 0.2% THC, which is the legal limit in the UK. What does novel food mean for CBD?

The classification of CBD as a novel food only applies to ingestible products such as CBD oils and CBD capsules. It essentially ensures that all manufacturers supply CBD products with accurate labeling.

Only ingestible broad spectrum CBD and CBD isolate products are legal and do not have a place for full spectrum products.

UK CBD retailers must either partner with a novel food compliant supplier of CBD isolate or order white label wholesale products from a supplier with an approved novel food application.

Can I get CBD on the NHS?

In theory, it is certainly possible to purchase CBD through the NHS in 2021. In reality, the actual process is full of red tape.

One must first acquire a prescription from a specially licensed cannabis clinic, which in itself is an expensive and time-consuming act. Once this is purchased, you will have to pay monthly for your desired products.

Kansas farmers struggling to sell hemp for industrial purposes



PRATT – This summer marks the third year Kansans has been growing hemp for industrial purposes.

However, growing the plant’s less sexy cousin, associated with climbing high and some medicinal uses, has proven riskier and more difficult than many farmers originally anticipated.

As a result, the number of licenses issued this year is less than half of what the state saw in 2020.

“There has been some misunderstanding about ease of marketability,” said Braden Hoch, the state director of the industrial hemp program.

A farm’s risk is exacerbated by an ever-changing set of state and federal regulations. And now some hemp growers and processors want more help from the government to reduce risk and encourage innovation.

Shining Star Hemp Co. is one of only 11 licensed hemp processors in the state.

Outside the industrial building near Pratt Municipal Airport in south-central Kansas where Shining Star operates are rows of 1,200-pound sacks of industrial hemp stems, grains and flowers.

Inside, workers break open the sacks and toss them onto a large conveyor belt that leads to a cacophony of machines that shake, blow, and sift the biomass into its usable parts.

The company is one of the few successful companies in the state.

“It was a lot of work, lots of phone calls to build relationships and find synergies,” said Jennifer Holmes, who works with Shining Star to develop and market products. “But to be honest, I can say at this point that we are great for our position.”

Complex process that is holding back the hemp industry

Paul McGeary developed Shining Star’s system for converting the hemp crop into something that the industry can use.

“It’s probably about 30 years of banging your head against the wall, mostly,” he said.

McGeary is a contractor for Shining Star. He has worked in the agricultural processing world for most of his life and applied what he learned over decades of sieving wheat and corn to develop this machine for sieving hemp.

He said the complexity of the process is part of what is holding the industry back. It just isn’t the size to cater to manufacturers who would use the fiber.

“We went to these meetings thinking that having £ 30,000 to £ 40,000 on hand was something. But when you get into the industry and they want five wagons a day or a trainload a week, we’re just not prepared for that, ”he said. “And making them wait until we are prepared is the bottleneck of the whole thing.”

Hemp has been hyped as something with a wide variety of industrial uses. The stem can be made from paper or biodegradable plastics. The seeds can be processed into food. And the flowers can be pressed to extract oils.

But so far the only market the industry is pushing seems to be for their cannabinoid-rich or CBD oil. And there is already a deluge of CBD on the market.

“We’re not very lucky to sell full-spectrum oil,” said Holmes. “It’s just something that we all have to work through and do the right thing and get into the grain and fiber industry.”

But that’s going to cost millions of dollars in investments in new equipment.

Until this equipment can be designed, built, or purchased, companies interested in making products from hemp fiber are out of luck. A company in Newton wants to make limbs out of hemp. It imports its processed hemp from overseas.

The licenses for hemp cultivation will decrease in 2021

Holmes wants more government aid to offset some of the risk of investing in converting the facility into something useful for industry.

“A lot of people are scared to start because they don’t know if they’re going to fail, so they never start,” she said.

The Kansas Department of Agriculture says its hemp growing licenses have dropped from 218 in 2020 to just 81 this year.

And last year, of the nearly 4,000 hectares that were planted, only 761 were harvested for production.

An eighth of it had to be burned by the state because it contained too much of the psychoactive chemical THC.

“The last two years have really helped individuals stay up to date,” said Hoch. “But producers still determine how hemp can best be grown as a useful crop and incorporated into their crop rotation.”

He said growers and processors need to expand beyond CBD products, but as federal and state regulations for harvesting are constantly changing, finding the right investors to embrace this kind of innovation and development will remain difficult can drive forward.
