State crime labs are experiencing major delays processing drug evidence

COLUMBUS – Ohio has a heavy backlog of drug evidence in its state crime labs, resulting in longer waiting times for charges and cases to be brought to large juries.

The problem is so bad that the Ohio Bureau of Criminal Investigation sent a letter to the prosecutor this month informing them of the delays and explaining how Attorney General Dave Yost is planning to fix the problem.

In the letter, Yost and BCI Superintendent Joseph Morbitzer blame Senate Bill 57 for the problem of requiring the state to test tetrahydrocannabinol, or THC in hemp, and COVID-19.

Bethany McCorkle, Yost’s communications director, said drug detection, which is typically processed in about 36 days, now averages 120 days.

“To tackle the backlog, the AG has put in place a system that can be used to review drug chemical filings with BCI,” McCorkle told the Canton Repository.

The new system will speed up testing and allow staff to handle the backlog by prioritizing cases as they are submitted, she said.

Why is there a backlog?

The backlog is due to two significant challenges over the past year, Yost said.

The first concerns the coronavirus pandemic. BCI had to switch work schedules to limit the number of people in the crime labs to allow social distancing, McCorkle said.

During the first few weeks of the pandemic, staff were divided into alternating groups, split between test subjects in the lab and remote reporting. This division of work processes has been increased to 75% of the working time in the laboratory.

“We are confident that a return to normal laboratory headcount and a return to a traditional workflow will reduce the turnaround time for chemical submissions, including marijuana quantification,” said Steve Irwin of the AG’s office.

The state has six BCI locations. Four locations with evidence testing laboratories are in London, Richfield, Springfield and Bowling Green. The two remaining facilities in Youngstown and Athens only receive evidence and distribute the records to the four laboratory locations.

According to the AG’s office, 150 forensic experts work at BCI’s four laboratory locations.

What’s the other challenge?

The second challenge, creating backlogs in evidence processing, concerns Senate Draft 57, passed in 2019 that legalized the cultivation of cannabis known as hemp in Ohio.

Hemp cannabis is used in products like CBD oils and vape pens.

The cannabis remains legal as long as the psychoactive ingredient THC is less than 0.3%. If the THC level is higher than 0.3%, it is considered marijuana and is no longer legal.

Before the bill was approved, the crime labs only tested for the presence of THC, not the amount of THC.

“The quantitation tests that are now required for marijuana are time and labor intensive,” Yost said, adding that BCI had to reallocate resources to comply with new state regulations.

New triage process

When drug cases arise, law enforcement agencies request the state for a drug chemistry kit.

Agencies sending drug evidence to laboratories must submit a completed and updated Drug Evidence Request questionnaire. The information provided from the form is used to prioritize requests by asking what criminal charges are being filed and how much weight the evidence is likely to be.

The agencies can also enter additional information to expedite and prioritize the case.

For marijuana, BCI prioritizes tests for first-, second-, and third-degree crime, Yost said.

Cannabis vaping products are tested to see if they contain hemp or marijuana.

How do delays affect communities?

The longer it takes for authorities to get the crime lab results, the longer prosecutors wait to file charges or bring cases to a grand jury.

The delay poses a security risk to the public unless an urgent order is requested and approved by laboratories, some prosecutors say.

“Belated justice is justice denied,” said Ashland County Attorney Christopher Tunnell.

“The laboratory confirmation presented by BCI is designed to move the case from a mere probable cause to an unequivocal one,” he added. “While reasonable doubt does not come into play until after the trial, prosecutors need to quickly consider trial considerations. The amount of time someone waits for a final decision on their case is fundamental to their rights as a citizen. Wait On Lab report consumes fast testing time. ”

In Ashland County, there are 64 drug evidence applications pending results from BCI laboratories.

It’s not just about bringing justice, it’s also about the safety of the public and the community.

“If we delay the initial arrest, we will delay treatment of individuals and potentially endanger the safety of the public,” said Tunnell.

Columbiana County Attorney Vito Abruzzino said law changes are needed at the state level to allow prosecutors to process cases quickly and indict a grand jury.

In Stark County, Kyle Stone prosecutors said they use local laboratories to process most of the evidence and the county was not badly affected by the lagging evidence from the state.

Which counties have the highest arrears?

Summit County tops the list of counties with the highest backlog of chemistry kits at 429, according to the BCI. The other counties in the top 5 are:

  • Franklin: 404
  • Trumbull: 355
  • Portage: 296
  • Butler: 293

Despite the high volume of lagged cases, Summit County Attorney Sherri Bevan Walsh is not concerned.

“We work with BCI every day and have no concerns,” said James Pollack, director of communications for Summit County’s attorney’s office.

Meanwhile, Cuyahoga County is at the forefront of most cases with quantitative THC analysis at 122. The remaining five are:

  • Trumbull: 40
  • Portage: 30
  • Franklin: 29
  • Auglaize: 26

Why are DNA tests delayed in BCI laboratories?

There are also delays in DNA testing in BCI laboratories, but not nearly as often as in drug chemistry testing.

“DNA is typically processed within 26 days and the current turnaround is 31 days,” said McCorkle.

The AG’s office suggested that prosecutors use outside laboratories in some cases to expedite processing.

BCI is working to outsource some traditional chemistry cases that will go to the Hamilton County Coroner’s Lab and Cuyahoga County Forensic Lab, Irwin said on Wednesday.

“The numbers will be finalized by the end of the week, but that would likely add 450 cases,” said Irwin

“There’s no doubt that COVID has slowed a lot of things over the past year and lab test turnaround time has been no exception,” McCorkle said.

The Bureau of Criminal Investigations and the Attorney General said they continue to look for additional ways to clean up the backlog.
