The legal dilemma of hemp production in Pakistan

He also pointed out that there are significant logistical challenges even when the climate and landscape are ripe for hemp, pointing to the lack of adequate infrastructure and arduous licensing and certification requirements in the country.

Junaid Zaman, the CEO of Shamanic Biohacker, started a successful CBD e-commerce company in 2020. Its operation has no local supply chain, and the CBD extract used is sourced internationally through renowned biotech laboratory partners who adhere to U.S. food and drug approval regulations.

However, the carrier oil used in the end product is sourced and manufactured locally. Zaman plans to move this supply chain in-house as soon as the locally grown crop is available in Pakistan in March next year.

However, such startups fear that large orders will be awarded to existing big players. “The approved license for the cultivation of industrial hemp as a crop in three districts goes to existing and established players in the tobacco industry,” Zaman tells DW.

“The affected multinational organizations will apparently grow crops instead of tobacco in the districts this year with approval.”

However, observers remain optimistic and believe that Pakistan has the potential to become the industry leader in this sector if the government avoids repeating the mistakes of other countries and actively involves local and foreign experts to ensure sustainability.

Rigorous judicial review

The term “hemp” has been judicially examined. Under the Control of Narcotics Substance Act of 1997, it is illegal in Pakistan to produce, manufacture, extract, prepare, possess, offer for sale, sell, buy or distribute cannabis.

However, after obtaining approval from the state or federal government, cultivation is permitted for medical, scientific or industrial purposes. If a violation of the above provisions is found, this will be punished with imprisonment of up to seven years, with a fine or with both.

Enforcing hard drug laws is a priority in Pakistan, while personal cannabis use is often overlooked. This is especially true of various tribal regions of Pakistan where cannabis is sometimes sold in public markets.

In 2020, a petition was filed with the Sindh High Court to legalize possession and use of 10 grams of cannabis. However, expressing displeasure, the court dismissed the petitioner and dismissed the petition (Sindh High Court order of November 6, 2020).

In 2020, a Federal Shariat Court single bench was delighted to acquit a defendant who was charged with 27 bags of hemp for failing to prove his case (YLR 2020 Federal Shariat Court Note 4).

In 2015 a hemp case was seized in the Lahore High Court and the High Court was delighted to give a defendant bail after arrest, as the defendant’s case falls under Article 4 of the Prohibition (Enforcement of Hadd) Order, 1979 (Order dated August 20, 2015 by the Lahore High Court).

In 2008, a hemp division, Bench of the Lahore, granted a defendant bail after his arrest on the grounds that “Shang” was not hemp within the meaning of S.2 (d) (ii). of Control of Narcotics Substances Act, 1997, and placed the defendant’s case for further investigation under Section 497 (2) of the Criminal Procedure Code of 1898 (PCrLJ 2008 Lahore High Court 750).

In 2007, a division of the Lahore Supreme Court granted bail to a defendant who was a woman, and nothing was recovered from her in one case involving hemp as the case fell within the scope of Article 4 Prohibition (Enforcement of Hadd) Order, 1979, imposed with a maximum RI sentence of two years (YLR 2007 Lahore High Court 3021).

In 2007, a single bank in the Karachi High Court acquitted a defendant charged with possession of hemp (MLD 2007 Karachi High Court 97).

In 2000, a hemp division, Bench Division of the Karachi Supreme Court, granted a defendant bail on the grounds that the defendant was no longer needed for the investigation and that the defendant’s trial had not yet begun. The substance seized by the defendant fell within the scope of the Prohibition (Enforcement of Hudd) Order, 1979, but was not mentioned in the Control of Narcotics Substances Act, 1997.

While legalizing hemp production is said to bring economic benefits to the country, it could also have legal implications!
