The legal dilemma of hemp production in Pakistan



In September 2020, the Federal Government approved and approved the Ministry of Science and Technology to cultivate industrial hemp for medical, scientific and industrial purposes. Said permit is regulated in accordance with Rule 2 (ix), 8, 9 and 10 of the 2001 Narcotics Control.

Against this background, the Ministry of Science and Technology (MOST) carried out an “Expression of Interest” (EOI) in the form of a joint venture (JV) for the production of hemp for medical, scientific and industrial purposes.

To promote this, the President of the Islamic Republic of Pakistan, exercising his powers under Article 89 of the Constitution of the Islamic Republic of Pakistan 1973, was pleased to issue Ordinance No. XIII of 2020 entitled “The Special Technology Zones Authority Ordinance 2020”. to enact ”.

The Pakistani government approved the legalization of hemp production on Tuesday, September 1st, 2020. Cannabis is widespread in Pakistan and is smoked as charas (hashish) or drunk as a bhang. According to a 2013 report, 6.4 million people in Pakistan use cannabis. Now that hemp has been granted legal status and has been placed under government control, it is now used to make products such as CBD oil, hemp seeds, medicinal products, and industrial products.

Helga Ahmed, a German environmentalist who has lived in Pakistan for 60 years, says: “Hemp is very resistant to bad weather. Monopoly in hemp production?

Despite its potential socio-economic advantages, Pakistan is facing shortages in ramping up hemp production. Environmentalists who have campaigned for hemp legalization are concerned about the vertical integration model the government could adopt.

“Hemp is naturally a carbon-negative plant, but if the government relies solely on vertical integration, it will become carbon-positive,” Mo Khan, Green Gate Global, UK, told DW. “The technology needs to be brought in, but also the indigenous knowledge base of the farmers who have grown hemp for the past 2,000 years,” he said.

Khan, who has worked with grassroots farmers, said allocating at least 25% of hemp production to smallholders is the only way to ensure sustainable production. He also pointed out that there are significant logistical challenges even when the climate and landscape are ripe for hemp, pointing to the lack of adequate infrastructure and arduous licensing and certification requirements in the country.

Junaid Zaman, the CEO of Shamanic Biohacker, started a successful CBD e-commerce company in 2020. Its operation has no local supply chain, and the CBD extract used is sourced internationally through renowned biotech laboratory partners who adhere to U.S. food and drug approval regulations.

However, such startups fear that large orders will be awarded to existing big players. “The approved license for the cultivation of industrial hemp as a crop in three districts goes to existing and established players in the tobacco industry,” Zaman tells DW.

“The affected multinational organizations will apparently grow crops instead of tobacco in the districts this year with approval.”

However, observers remain optimistic and believe that Pakistan has the potential to become the industry leader in this sector if the government avoids repeating the mistakes of other countries and actively involves local and foreign experts to ensure sustainability.

Rigorous judicial review

The term “hemp” has been judicially examined. Under the Control of Narcotics Substance Act of 1997, it is illegal in Pakistan to produce, manufacture, extract, prepare, possess, offer for sale, sell, buy or distribute cannabis.

However, after obtaining approval from the state or federal government, cultivation is permitted for medical, scientific or industrial purposes. If a violation of the above provisions is found, this will be punished with imprisonment of up to seven years, with a fine or with both.

Enforcing hard drug laws is a priority in Pakistan, while personal cannabis use is often overlooked. This is especially true of various tribal regions of Pakistan where cannabis is sometimes sold in public markets.

In 2020, a petition was filed with the Sindh High Court to legalize possession and use of 10 grams of cannabis. However, expressing displeasure, the court dismissed the petitioner and dismissed the petition (Sindh High Court order of November 6, 2020).

In 2020, a Federal Shariat Court single bench was delighted to acquit a defendant who was charged with 27 bags of hemp for failing to prove his case (YLR 2020 Federal Shariat Court Note 4).

In 2015 a hemp case was seized in the Lahore High Court and the High Court was delighted to give a defendant bail after arrest, as the defendant’s case falls under Article 4 of the Prohibition (Enforcement of Hadd) Order, 1979 (Order dated August 20, 2015 by the Lahore High Court).

In 2008, a hemp division, Bench of the Lahore, granted a defendant bail after his arrest on the grounds that “Shang” was not hemp within the meaning of S.2 (d) (ii). of Control of Narcotics Substances Act, 1997, and placed the defendant’s case for further investigation under Section 497 (2) of the Criminal Procedure Code of 1898 (PCrLJ 2008 Lahore High Court 750).

In 2007, a division of the Lahore Supreme Court granted bail to a defendant who was a woman, and nothing was recovered from her in one case involving hemp as the case fell within the scope of Article 4 Prohibition (Enforcement of Hadd) Order, 1979, imposed with a maximum RI sentence of two years (YLR 2007 Lahore High Court 3021).

In 2007, a single bank in the Karachi High Court acquitted a defendant charged with possession of hemp (MLD 2007 Karachi High Court 97).

In 2000, a hemp division, Bench Division of the Karachi Supreme Court, granted a defendant bail on the grounds that the defendant was no longer needed for the investigation and that the defendant’s trial had not yet begun. The substance seized by the defendant fell within the scope of the Prohibition (Enforcement of Hudd) Order, 1979, but was not mentioned in the Control of Narcotics Substances Act, 1997.

While legalizing hemp production is said to bring economic benefits to the country, it could also have legal implications!

Whether you’re entertaining a lot or just being pampered, the chocolate martini is one of the most delicious ways to end a long day. Plus, a little squirt of Tribe CBD oil makes everything better, right?

CBD Chocolate Martini Recipe

Dark chocolate has been all the rage on organic blogs lately. According to many foodie bloggers, consuming some dark chocolate every day could have tremendous health benefits. But are these sweet rumors backed by science? And if so, how much chocolate is too much?

First off, there is compelling evidence that dark chocolate is rich in healing antioxidants. In fact, some researchers believe that consuming dark chocolate could improve heart and brain health. Get This: A recent study found that people who consumed just 0.2 ounces of dark chocolate a day had a significantly lower risk of having a heart attack.

In general, the more bitter your chocolate, the more likely it is that it contains high levels of antioxidants. Most nutritionists strongly recommend reaching for a candy bar that is at least 70 percent dark. Try to keep your daily dosage in the one to two ounce range if you can hold back!


  • 1 ½ ounce. Baileys Irish Cream
