State and federal regulation of CBD will help provide a consistent, trustworthy product for consumers

In the midst of the current gold rush, brands and product lines are being further diversified and expanded. In recent years, the Food and Drug Administration has sought to develop a cohesive set of guidelines for the manufacture and trade of CBD, with individual states hastily implementing their own patchwork of regulations. Unfortunately, the lack of clear federal guidelines has left consumers vulnerable to substandard products that are inferior in terms of potency and purity.

While a comprehensive legal reform is on the horizon in N.that York and the US., consumers now need independent insight into this emerging market. Just as American cowboys have crossed the western border in the midst of a climate of lawlessness, CBD has similarly swept the US (and the world at large). Ointments, edibles, tinctures, balms, and capsules are exploding in the market alongside CBD-infused niche beverages, foods, skin care, pet care, and hair care products, with many making unsubstantiated claims about the benefits of wellbeing.

The global CBD market is expected to be reached $ 3.5 billion this year but Industry reports have shown that many of these products do not fulfill their promise of potency or quality. While consumers are thrilled with the real therapeutic promise of this cannabinoid, it is also unscrupulous manufacturers and retailers who see the potential to sell snake oil and make money.

A number of factors make regulating the CBD space a challenge. For starters, it’s a category-bending link in many ways. It is a cannabinoid that is not intoxicating but is psychoactive. The FDA regards CBD as a drug or “active ingredient”. although hemp (containing 0.3% THC or less) is legal at the federal level, meaning its inclusion in food and beverages has regulatory complications. This was particularly evident in New York, where the city’s Department of Health moved in 2019 to ban CBD-infused foods and beverages from bars and restaurants.

The FDA is refining its stance towards CBD, examining available research on its therapeutic benefits, side effect profile, long-term use, and dosage guidelines. At this point in time, the FDA has approved only one CBD product, Epidiolex, which is used to treat seizures in certain forms of childhood epilepsy.

As it stands, consumers need to deal with CBD products (and their sometimes opaque claims) themselves – or understand the rapidly changing legal landscapes in their home state. New Yorkers, for example, are subject to the extensive and stringent regulations of Governor Andrew Cuomo’s 2020 Cannabinoid Hemp Program – but this program is being revised as changes are made the soon to be established Office of Cannabis Management after the Marijuana Ordinance and Tax Act 2021 comes into effect. For those not or not interested in keeping up with the rapid changes in the law, simple, clear information about the quality and effectiveness of CBD products is invaluable.

The instability and inconsistency between state and federal regulations on CBD has created a sloppy patchwork of rules that can adversely affect consumers and the industry at large. The recent introduction of the Hemp Access and Consumer Safety Act of 2021 could be the fulcrum bringing order to chaos at the national level. When it is enacted The legislation would change federal food, drug and cosmetics law and allow CBD made from hemp to be classified as a food and dietary supplement.

The FDA regards CBD made from hemp as a drug. The regulatory framework surrounding updating the law prevents the FDA from establishing clear regulatory frameworks for hemp and hemp-derived CBD when used as a food and dietary supplement. This landmark legislation would subject foods and supplements containing hemp and CBD to all safeguards provided by the FDA’s food and supplement regulatory framework.

Additionally, the measure would prioritize consumer safety by requiring that manufacturers comply with all existing federal regulations for products containing CBD and ensuring that those products are properly labeled.

It’s important to realize that significant changes in law in the states will help streamline the rules governing the use of CBD. In New York, for example, the passage of the Marijuana Regulation and Taxation Act signals changes not only for adult cannabis, but also for CBD. As stated in a recently released memo, the legislation creates a new cannabis management bureau headed by a cannabis control board to oversee and implement the measure. The Office of Cannabis Management will oversee the state’s existing cannabinoid hemp program, which is regulated by the Department of Health. With the revision of the CBD and hemp program and making it a single entity, consumers, retailers and manufacturers will, with luck, be provided with clearer guidelines.

Tdid it work? The changes introduced by these respective bills will most likely result in more consistent and concise regulations and improve and standardize CBD product quality. It’s a change that this fast-growing industry can only benefit from.
